Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") form a binding agreement between you ("you", "your") and Bhupendra Singh, sole proprietor trading as ReplySmooth ("we", "us", "our") when you use ReplySmooth (the "Service"). By signing in or using any feature, you accept these Terms and our Privacy Policy. If you don't agree, don't use the Service.

2. Who can use the Service

You must be 18 years of age or older. At sign-in you confirm that you meet this requirement. If we learn that you are under 18, we will close your account and delete your data.

You must also:

  • Have the legal capacity to enter a contract in your jurisdiction
  • Not be barred from using the Service under any applicable law
  • Not have had your account previously terminated by us for violating these Terms

3. What the Service does

ReplySmooth is an AI-assisted helper for dating-app conversations. Core features include:

  • Reply Suggestions — generates reply options based on a message you paste in
  • AI Wingman — a stateful chat thread where the AI helps you think through conversations
  • Opening Lines — generates openers based on a match's profile information you enter
  • Improve Reply — polishes a draft message you've written
  • Profile Review — critiques your dating profile based on the bio and photo descriptions you provide

The Service does not connect to any dating app directly. You control what you paste in and what you send out. We are a text-generation tool, not a messaging platform.

4. Your account

  • Sign-in is via Google OAuth. You must use a Google account that you control.
  • You are responsible for keeping your account credentials secure. If you suspect unauthorized access, sign out from all devices via your account page and email us at support@replysmooth.com.
  • One account per person. Creating multiple accounts to bypass fair-use limits, credits, or any other restriction is a violation of these Terms.

5. Credits and paid plans

  • New accounts receive 100 free replies on sign-in.
  • Paid tiers (Weekly, Monthly) expand this limit and unlock additional features. Current pricing is shown on our Pricing page and may change with notice.
  • Payments, when introduced, will be handled by a payment processor. Card data is never stored by us.
  • Auto-renewal: paid subscriptions renew automatically for the same billing period unless cancelled at least 24 hours before renewal. You can cancel anytime from your account page; access continues until the end of the current period.
  • Refunds: we do not generally refund partial billing periods. Refunds for billing errors or duplicated charges will be processed within 7 business days of acknowledgement. Statutory rights under the Consumer Protection Act, 2019 are not affected.

6. Acceptable use

You agree to use the Service only for lawful, reasonable purposes. Specifically, you agree not to:

  • Generate, refine, or distribute content that is unlawful, threatening, defamatory, obscene, invasive of another's privacy, or involves child sexual abuse material in any form.
  • Use the Service to harass, stalk, intimidate, impersonate, or deceive any person.
  • Use the Service to send unsolicited bulk messages (spam) or to automate conversations with many recipients.
  • Attempt to reverse-engineer, scrape, or clone the Service or any of its AI prompts, models, or server code.
  • Circumvent rate limits, authentication, the credit system, bot protection, or any other technical safeguard.
  • Use the Service in a way that violates the terms of service of any dating platform (Tinder, Bumble, Hinge, Aisle, Instagram, etc.). You are solely responsible for your conduct on those platforms.
  • Use the Service to solicit commercial transactions, collect payment, or promote businesses to people you're messaging.
  • Present AI-generated suggestions as professional advice (legal, medical, psychological, financial) to yourself or anyone else.

We may suspend or terminate your account without notice if we reasonably believe you have violated this section.

7. Your content and AI-generated content

Your input. When you paste messages, draft replies, or profile text into the Service, you retain all rights to that content. You grant us a limited, worldwide, royalty-free license to process that content solely to provide the Service to you (i.e., to generate the AI response and maintain session history). We do not use your content to train AI models. We do not sell or share your content with third parties except the processors listed in our Privacy Policy.

AI output. The suggestions, replies, openers, critiques, and other text the AI produces for you ("Output") are provided for your personal use. Subject to these Terms, we grant you the right to use that Output freely, including sending it on dating apps as your own message. We do not claim ownership of the Output.

No guarantees about Output. AI output:

  • Is generated on the fly based on your input and may contain errors, misinterpretations, or inappropriate suggestions
  • Is not professional advice — legal, medical, psychological, financial, or otherwise
  • Does not guarantee matches, replies, dates, relationships, or any other outcome
  • Reflects statistical patterns in language, not truth

You are responsible for what you send. Before forwarding any Output to another person, read it and decide whether it is appropriate in your specific context. We are not liable for the consequences of sending AI-generated text.

8. Intellectual property

  • Our IP: the Service's design, code, branding, product name, AI system prompts, and overall architecture belong to Bhupendra Singh, sole proprietor trading as ReplySmooth and our licensors. You may not copy, modify, distribute, or create derivative works based on any of it without our written permission.
  • Feedback: if you send us feedback, suggestions, or ideas, you grant us a perpetual, royalty-free license to use that feedback without compensation.

9. Third-party platforms

The Service helps you compose messages for third-party dating platforms (Tinder, Bumble, Hinge, etc.). We are not affiliated with, endorsed by, or sponsored by any of those platforms. Use of the Service does not grant you any rights on those platforms, and their terms apply independently.

10. Disclaimer

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted operation.

We do not warrant that:

  • The Service will be error-free or available at all times
  • AI output will be accurate, appropriate, or useful for your situation
  • The Service will achieve any particular outcome for your dating life

11. Limitation of liability

To the fullest extent permitted by law:

  • We will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of relationships, matches, conversations, business, data, or opportunity.
  • Our total aggregate liability for any claim arising out of or related to these Terms or the Service is limited to the greater of ₹10,000 (ten thousand Indian Rupees) or the total amount you paid us in the twelve months preceding the event giving rise to the claim.

Nothing in this section limits liability for fraud, wilful misconduct, or any liability that cannot be excluded under applicable law (including rights under the Consumer Protection Act, 2019).

12. Indemnification

You agree to indemnify and hold harmless Bhupendra Singh, sole proprietor trading as ReplySmooth, its directors, officers, employees, and contractors from any claim, demand, or proceeding brought by a third party arising out of:

  • Your violation of these Terms
  • Your violation of any third-party right (including privacy, IP, or contractual rights)
  • Your misuse of AI output — for example, sending harassing, defamatory, or unlawful material to another person based on our suggestions.

13. Termination

By you: you may stop using the Service at any time. To permanently delete your account and data, use the Delete Account option (when available) on your account page or email support@replysmooth.com.

By us: we may suspend or terminate your access at our discretion, with or without notice, if we reasonably believe you have violated these Terms or if continued access poses a risk to us or other users.

On termination: your right to use the Service ends immediately. Sections 7 (your content and AI output), 8 (IP), 10 (disclaimer), 11 (limitation of liability), 12 (indemnification), and 15 (governing law) survive termination.

14. Changes to these Terms

We may update these Terms from time to time. If a change is material (for example, a new category of prohibited use or a change that reduces your rights), we will notify you by email and an in-app notice at least 14 days before it takes effect. Continued use of the Service after the effective date means you accept the updated Terms. If you don't agree to the change, stop using the Service and delete your account.

15. Governing law and dispute resolution

  • These Terms are governed by the laws of India.
  • Any dispute that cannot be resolved informally will be submitted to the exclusive jurisdiction of the courts at Labitha Enclave, Devarachikkanahalli Main Rd, Maruthi Layout, Royal Shelters, Bommanahalli, Bengaluru, Karnataka 560114 (location of our registered office).
  • Before filing any court action, please reach out to support@replysmooth.com — we'd genuinely like to resolve things without a courtroom.

This section does not limit any mandatory consumer-law protections that apply to you where you live.

16. Miscellaneous

  • Entire agreement. These Terms and our Privacy Policy are the complete agreement between you and us regarding the Service.
  • Severability. If any provision is unenforceable, the remaining provisions stay in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
  • No agency. Nothing in these Terms creates a partnership, employment, or agency relationship between you and us.
